These Terms of Service (the "Terms") are an agreement between you and Yomit.ai ("we", "us") that governs your use of https://www.yomit.ai, its API, and every feature offered through them (together, the "Service"). Please read them carefully. By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
- Who may use the Service
- You must be at least 18 years old to create an account or buy a plan. If you are younger, you may use the Service only with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf.
- You may use the Service only where it is lawful to do so, and you are responsible for complying with the laws that apply to you.
- Your account
- Most of the Service can be used without an account. The dictionary, Learn packs, JLPT Grammar, and the kana charts work without one. Writing Practice is available to guests with a smaller sheet. The Reading Assistant, Listening Practice, and Image Assistant need an account. You can register with your name, e-mail address, and a password.
- The information you give us must be accurate and kept up to date. You may have only one account, and you may not create an account for anyone other than yourself or use someone else's account.
- You are responsible for everything that happens under your account. Keep your password and your API token secret, enable 2-factor authentication if you can, and tell us at security@yomit.ai straight away if you think someone else has used your account. Changing your password signs out every other device.
- Accounts that are registered but not activated with the link we e-mail you within five days are deleted.
- Plans, limits, and changes to the Service
- The Service is offered on a free plan (Kana) and on paid monthly plans. What each plan includes, together with its character limits, monthly allowances of writing practice pages, AI tokens, and JLPT mock tests, and its current price, is described on the Plans & Pricing page, which forms part of these Terms. Guests who are not signed in have lower limits than any plan.
- Allowances are per billing period and do not carry over. When an allowance is used up, the feature pauses until the period resets; features that have a standard, non-AI engine fall back to it automatically.
- We are always improving the Service. We may add, change, or remove features, adjust the limits and allowances of any plan, and change our prices. If we increase the price of a plan you are on or materially reduce what it includes, we will tell you by e-mail or with a notice on the site at least 30 days before the change takes effect for you, and you may cancel before then.
- Payment, renewal, and cancellation
- Paid plans are billed monthly in advance in USD at the price shown when you choose the plan, plus any applicable taxes. Payments are processed by Stripe; your card details are sent directly to Stripe and we do not see or store them. By choosing a paid plan you authorise us to charge the card on file each month on your billing date until you cancel.
- When you upgrade, you are charged the price of the new plan immediately and its features and allowances are available straight away. When you downgrade, the features of your current plan stay available until the end of the period you have already paid for, after which the new plan takes effect.
- You can cancel at any time by switching to the Kana plan on the Plans & Pricing page. Your paid features remain available until the end of the current billing period and you will not be charged again. Your account and your notes are kept; My Notes simply becomes unavailable until you return to a plan that includes it.
- Payments are not refundable, in whole or in part, including for unused time or unused allowances, except where the law requires a refund.
- If a renewal payment fails, we will try the card again up to 3 times, 3 days apart. If every attempt fails your plan is downgraded to the Kana plan. You can update your card and choose a paid plan again at any time.
- Promotional codes are valid only for the plans, period, and conditions stated when they are issued, may be used once per account unless stated otherwise, and may be withdrawn if they are misused.
- AI features
- The AI word and sentence explanations, AI vision in the Image Assistant, the natural AI voice in Listening Practice, and the AI tools in My Notes are generated by a large language model provided by a third party. They are used only when you turn the AI switch on and ask for a result, and each request counts against the AI token allowance of your plan.
- AI output is generated automatically and can be wrong, incomplete, or misleading, even when it sounds confident. It is offered as a study aid, not as an authoritative reference, translation, or advice. Please check anything important against the dictionary or a teacher before you rely on it.
- JLPT mock tests are prepared from the same question types as the official test, but they are not official JLPT materials and a score on a mock test is not a prediction of your result on the real exam. JLPT is a trademark of the Japan Foundation and Japan Educational Exchanges and Services, with which we are not affiliated.
- Your content
- You keep ownership of everything you submit to the Service: the text you search for or paste, the pictures you give the Image Assistant, and the notes, books, and pages you write in My Notes ("Your Content").
- So that we can provide the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and display Your Content, including sending it to our service providers (such as our AI provider when you use an AI feature), solely for the purpose of operating and providing the Service to you. This licence ends when you delete the content or your account, except for copies in backups, which are overwritten in the normal course.
- You are responsible for Your Content. You confirm that you have the right to submit it and that it does not infringe anyone else's rights, break the law, or contain malicious code. We do not review Your Content, but we may remove content or suspend an account if we are told, or reasonably believe, that it breaks these Terms.
- Please keep your own copies of anything important. On the Sensei plan you can export any book at any time. Deleting a note, page, book, or account is permanent, and we are not responsible for content that is lost because it was deleted, because your plan ended, or because of a failure of the Service.
- Acceptable use
- You may use the Service for your own personal study and, through the API, in your own applications within the limits of your plan. You agree not to:
- copy, scrape, crawl, bulk download, or otherwise extract the dictionary data, grammar reference, mock test questions, or other content of the Service other than through normal use or the API within its limits;
- resell, sublicense, or provide the Service or its content to third parties as a service of your own, or share an account or API token with others;
- use the AI features to generate content that is unlawful, harmful, hateful, or abusive, or submit content of that kind;
- evade rate limits, allowances, plan restrictions, or security measures, probe or test the vulnerability of the Service without our written permission, or interfere with its operation;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent the law expressly allows;
- remove or alter any copyright, licence, or attribution notice, including the attributions on the Resources page; or
- use the Service in any way that breaks the law or infringes the rights of others.
- API
- The API gives your own scripts and applications access to the Service using a token that you create on the API page. Each account has one token, the token identifies you, and requests made with it are treated as made by you and count against the limits and allowances of your plan.
- All API requests must be made over HTTPS and are subject to rate limits, which are described on the API page and may change. If you receive a
429 Too Many Requests response you must slow down. We may suspend a token that is abused, shared, or used in a way that harms the Service. - If your application makes the Service's content available to others, it must display the attributions required by the third-party licences described below, and must not present the content as your own or as official JLPT material.
- Third-party content and licences
- The dictionary entries, kanji data, radical decompositions, and stroke order drawings are derived from the JMdict, JMnedict, KANJIDIC2, and KRADFILE files of the Electronic Dictionary Research and Development Group, from KanjiVG, and from the other open projects listed on the Resources page. That data remains the property of its authors and is provided under their licences, including Creative Commons Attribution-ShareAlike. Anything you take from the Service that is derived from that data is subject to those licences, including the requirement to give credit, and nothing in these Terms gives you rights to it beyond what those licences allow.
- The Service links to other websites. We are not responsible for their content, their privacy practices, or anything you do there, and a link is not an endorsement.
- Our intellectual property
- Apart from Your Content and the third-party content described above, the Service, including its software, design, text, grammar reference, mock test questions, practice sheet layouts, name, and logo, is owned by Yomit.ai or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms for as long as you comply with them. No other rights are granted.
- If you send us a suggestion or feedback, you agree that we may use it without any obligation to you.
- Privacy
- How we collect, use, and protect your personal information is described in our Privacy Policy, and how we protect payments is described on our Security page. Both form part of these Terms.
- Suspension and termination
- You can stop using the Service at any time, and you can ask us to delete your account by e-mailing privacy@yomit.ai or using the Contact Us form. Deleting your account cancels any paid plan and permanently removes your notes, mock tests, and account details.
- We may suspend or terminate your access to the Service, or to any feature or API token, if you break these Terms, if your use creates risk or legal exposure for us or for other users, if a payment is not made, or if we discontinue the Service. Where it is reasonable to do so we will tell you first and give you a chance to put things right. If we terminate your account for a breach, no refund is due.
- Sections 5 to 10 and 13 to 18 survive the end of these Terms.
- Disclaimer of warranties
- The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components. The dictionary data, grammar reference, AI output, text recognition, speech, and mock test questions may contain errors, and we do not warrant that they are accurate, complete, or current. The Service is a study aid and does not guarantee any learning outcome or exam result.
- Limitation of liability
- To the fullest extent permitted by law, Yomit.ai and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with the Service or these Terms, however caused and under any theory of liability, even if we have been told that such damages are possible.
- Our total liability for all claims arising out of or in connection with the Service or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim arose and fifty dollars (USD 50).
- Some jurisdictions do not allow some of these exclusions or limitations, so they may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
- Indemnity
- You agree to indemnify and hold harmless Yomit.ai and its owners, employees, contractors, and suppliers from any claim, loss, liability, and expense (including reasonable legal fees) arising out of Your Content, your use of the Service, your use of the API in your own applications, or your breach of these Terms or of the law.
- Changes to these Terms
- We may update these Terms from time to time. The date at the top shows when they were last changed. If a change is material we will tell you by e-mail or with a notice on the site at least 30 days before it takes effect. By continuing to use the Service after a change takes effect you agree to the updated Terms; if you do not agree, you should stop using the Service and may cancel your plan before the change takes effect.
- Governing law and disputes
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. Any dispute arising out of or relating to the Service or these Terms will be brought in the courts of Ontario, and you consent to their jurisdiction, except that either of us may seek an injunction or other urgent relief in any court with jurisdiction. If you are a consumer, nothing in this section takes away protections that the law of the place where you live gives you and that cannot be excluded by agreement.
- Before starting any formal proceeding, please contact us so that we can try to resolve the problem informally.
- General
- These Terms, together with the Privacy Policy, the Security page, and the Plans & Pricing page, are the entire agreement between you and us about the Service. If any part of these Terms is found to be unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the Service. Neither of us is liable for failing to perform because of events beyond our reasonable control.
- Questions about these Terms can be sent to webmaster@yomit.ai or through our Contact Us form.
